Terms of Service

Effective Date: June 13, 2026. Please read these Terms of Service carefully before utilizing our agency consulting website or our custom product developments.

1. Acceptance of Terms

By browsing the QByteSoft website, requesting professional software consultations, or entering into software development sprints, you agree to comply with and be bound by these Terms of Service and all applicable guidelines. If you disagree, please discontinue use immediately.

2. Professional Software Deliverables and IP Rights

Unless explicitly specified in a signed Master Services Agreement (MSA) or statement of work:

  • Client Ownership: Custom applications, custom liquid themes, database schemas, and private vector indices built specifically for a client transfer in ownership upon receipt of full and final milestone payment.
  • Pre-Existing Codebase: QByteSoft retains all rights, titles, and interests in and to our pre-existing software, generic templates, shared components, and library code utilized during client builds. We grant clients a perpetual, non-exclusive, royalty-free license to utilize such components.
  • In-house SaaS Products: Our own operational SaaS offerings (StoresForge, ShowForm, AutoGaragePro, etc.) are protected under proprietary software licenses. Subscriptions grant users a limited, non-transferable access license.

3. Disclaimer of Warranties

QByteSoft provides its services, tools, and custom deliverables on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

4. Limitation of Liability

In no event shall QByteSoft, its officers, or its software engineering managers be liable for any indirect, incidental, special, exemplary, or consequential damages. This includes, without limitation, loss of revenue, profits, databases, vector index corruption, server downtime, or third-party service changes (including Shopify API changes or cloud host outages) exceeding the total amount paid by you for the specific milestone or service.

5. User Responsibilities and Acceptable Use

When interacting with our forms, scheduling calendars, or accessing our private client dashboards, you agree:

  • To provide accurate details (business details, email addresses, specifications) in all consultation request forms.
  • Not to bypass, alter, or disable any security layers, authentication tokens, or rate-limiting firewalls.
  • Not to use automated scrapers, indexers, or bots to fetch system files without our written authorization.
